REGULAR BOARD MEETING

JULY 18, 2022

(PROPOSED MINUTES)

 

MEETING WAS CALLED TO ORDER AT 6 PM BY SUPERVISOR JIM MAZUR, ALSO PRESENT CLERK BARBARA EGELER, TRUSTEE  JEROME PAPES, TREASURER PATTI GEERS, TRUSTEE BOB KESLING WAS ABSENT.  WE HAD TWO GUEST ATTEND.  THE REASON THE  MEETING WAS CANCLED FOR JULY 11TH, WAS THE PARKING LOT AT THE HALL WAS GETTING NEW ASPHALT.

MINUTES WERE APPROVED AS PRESENTED.

JEROME MADE A MOTION TO APPROVE PAYMENT OF BILLS.  JIM SECONDED

MOTION CARRIED

COUNTY COMMISSIONER JANET ANDERSEN GAVE THE COUNTY REPORT.  THERE WILL BE  A TOWN HALL MEETING CALLED FROM THE MASON COUNTY PLANNING COMMISSION ON AUGUST 2, 2022 AT 7:00 PM AT THE MASON COUNTY EASTERN MULTI-PURPOSE ROOM.  MASON COUNTY ZONING IS SEEKING THE PUBLICS INPUT ON THE UPDATES FOR THE ZONING ORDINANCE.

THERE WAS NO SHERIFF’S REPORT.

TREASURER REPORTED THAT THE MONEY MARKET FUND BALANCE ON 5/31/22 WAS $402,153.46,  RECEIPTS WERE      $7,683.21, INTEREST WAS $33.63, DISBURSEMENTS WERE $16,740.20.  LEAVING A BALANCE OF $393,130.10 ON 6/30/22.

CHECKING ACCOUNT BALANCE REMAINS AT $300.00 ON 6/31/22.

PERPETUAL CARE CERTIFICATE BALANCE REMAINS AT $62,821.14 ON 6/30/21.

PUBLIC IMPROVEMENT FUND BALANCE REMAINS AT $292,216.59 ON 6/30/22.

HALL RESERVATION FUND ON 5/31/22 WAS $1,120.12, NO RECEIPTS, NO DISBURSEMENTS, INTEREST WAS .05 cents,    LEAVING A BALANCE OF $1,120.17 ON 6/30/22.

TAX ACCOUNT BALANCE 0N 5/31/22 WAS .00 AND REMAINS AT .00 ON 6/30/22.

TREASURERS REPORT ACCEPTED AS PRESENTED

JIM MADE A MOTION TO APPROVE A DOCK PERMIT FOR JACK DEHORN.  JEROME SECONDED

JIM REPORTED THAT HE HAD RECEIVED A CALL AND AN EMAIL FROM ATTORNEY NEIL JANSEN .

ATTORNEY JANSEN TOLD JIM HE HAD RECEIVED AN EMAIL FROM ATTORNEY ALVARADO CONCERNING THE  BOATHOUSE ON THE TOWNSHIP PARK PROPERTY,  HE SAID HIS CLIENT WANTED TO EXPLORE THE POSSIBILITY OF A SOLUTION TO  THE BOATHOUSE CONTROVERSY.  HIS  CLIENT WAS SUGGESTING THAT THE PARTIES COULD MEET WITH THEIR ATTORNEYS PRESENT, FOR THE PURPOSE OF SETTLEMENT ONLY AND PURSUANT TO THE CONFIDENTIALITY PROTECTIONS OF  MRE 408 ,  (RULE 408 EXCLUDES COMPROMISE EVIDENCE EVEN WHEN A PARTY SEEKS TO ADMIT ITS OWN SETTLEMENT OFFER OR STATEMENTS MADE IN SETTLEMENT NEGOTIATIONS.) OPTIONS THAT MAY FACILITATE A SETTLEMENT AND AVOID THE TRIAL AND THE ADDED COSTS.

ATTORNEY JANSENS ANSWER BACK TO ATTORNEY ALVARADO,

CARLOS,

JIM MAZUR AND I HAVE DISCUSSED YOUR INVITATION.  WHAT DO YOU SEE AS POSSIBLE AVENUES TO SETTLEMENT?  WE ARE STRUGGLING TO ENVISION A MEANS OF RESOLVING THIS DISPUTE THAT DOES NOT INVOLVE CONFIRMATION THAT THE   BOATHOUSE LIES ON TOWNSHIP PROPERTY AS DEEDED BY THE CARTIERS, BUT WE ARE OPEN TO HEARING ANY REASONABLE IDEAS YOU MAY HAVE.

AS YOU KNOW, THE TOWNSHIP ONLY ACTS THROUGH ITS BOARD AND THE BOARD CAN ONLY ACT AT A PUBLIC MEETING.  IF THERE IS A POSSIBLE AVENUE FOR SETTLEMENT THAT MERITS BRINGING BEFORE THE BOARD, THE NEXT OPPORTUNTY WILL BE   AUGUST 1, 2022 BOARD MEETING AND WE COULD SCHEDULE TIME FOR A DISCUSSION AT THE MEETING, BUT THIS ONLY MAKES SENSE IF THERE IS SOME AVENUE THAT THE BOARD COULD LEGITMATELY CONSIDER IN LIGHT OF THE REVERTER CLAUSE IN THE DEED.
